Minnesota Supreme Court Appeal Day

9:51: MN live coverage begins in 10 minutes. Currently the courtoom is empty, but The Uptake is doing a lot of cool zooming shots.

10:04: Coleman attorney Joe Friedberg: We're making due-process and equal-protection claims. Admits the due-process claim came only recently. "You changed the rules after the game was played". Ha ha ha.

10:08: Justice Anderson: "Why is this offer of proof not inadequate?" Ouch.

10:14: Not an auspicious start for Friedberg. The justices seem very impatient and unimpressed.

10:17: From The Uptake on Twitter: @theuptake Q) How would voters have acted differently if diff standards were in place? A) That's not the issue #mncontest

10:24: Justice Anderson: "As loud as you speak on this issue, there's language here you just can't overcome".

10:25: Marc Elias is on for Team Franken. He is one handsome devil.

10:32: Team Franken lays down numbers, coldly and efficiently. There are fewer disputed ballots where voter wasn't registered than the margin between the two candidates

10:39: Franken team: Coleman's people had not identified all the ballots they had proof for until the end of the trial.

10:49: "Throwing sand in the gears of the election". Perfect summary of Team Coleman strategy. Well played, Marc Elias.

10:53: One advantage Marc Elias has over Joe Friedberg: he sounds calmer.

10:54: The judges like "every ballot tells a story". Rod Stewart is proud. Joe Friedberg HATES it, calls it "the biggest non-sequitur in the history of Anglo-American jurisprudence. Good to know this is a hyperbole-free courtroom!

10:56: Friedberg basically concedes Elias point - it's entirely possible that ballot which look illegal might actually be legal, we don't know, no one knows.

10:58: Classic Friedberg line: "We extrapolate in life". Unclear why this is relevant to election law.

11:00: Friedberg: We've no evidence of fraud or favoritism. That won't help his case.

11:13: Coleman now interviewing. It's really cute to hear him try to defend the "we only want to count ballots from Coleman-friendly precincts" strategy. Really, really cute.

11:17: Friedberg says "The Good  Republican Counties followed election rules, the Evil Liberals didn't, and that's why we're losing".

Final word from Coleman: the press asks "Will you appeal?"

Coleman response, basically: "if we lose".

    Coleman's "poor loser" character flaw merely compounds the negatives toward Republicans in the eyes of average American voters throughout the entire USA.

    The "cheap shot" effect adds greatly toward a general Republican Party demise in my own opinion.

    We call ourselves the bastions of democracy. Well, Lebanon just had its elections and the results, which were given soon after, found both winners and losers accepting the outcome. Here, in the USA, the GOP are forever trying to spread democracy to what they refer to as the third world. However, these are the same people who after nearly seven months continue to reject the voice of the people in Minnesota. Democracy!!!!

    Coleman is an interloper in MN politics, he lacks a core of being-first a dem and then a repug..switch positions according to the wind, no commitment other than to self - a belief system that sways with the wind - and perhaps most damning of all he lacks likeability - Norm, best advise, go back to New York or wherever, you simply do not fit in here - we like honesty, straight shooters, decency and clarity, all characteristics you lack....any position to make a personal gain, you are not Minnesota nice politics and you never wll fit in that mold. Please leave Minnesota the clean, good politics state it always has been and that includes real Republicans not faux such as yourself. bye bye

    Both of these guys are carpetbaggers from out of state. Coleman a Brooklynite, and Franken a cog from the daly machine in Chicago. Neither of them are REAL true Minnesotans. Neither attended a Vikings game at the old met stadium, caught an eel pout while ice fishing on White Bear Lake, or harvested wild rice with their own canoe near Mille Lacs. While Dean Barkley wasn't ever reqally seriously in contention, he DID get a sizeable share of the votes. And, at least he didn't wince when it came time to bait his OWN hook with leeches, and filet his own walleyes.
    Minnesotans need a Minnesotan to represent them.

    Seriously at this point Catch and Release don't you know that Al grew up here??! It was Norm that moved here from Boston and points East. But Al is from the Twin Cities. Not all Minnesotans like to fish (I am unaware of Al's stance on this) so when I cast my vote it is not based on who can catch fish! It is based on who will do the best job for MN.

    Welcome to reality, folks in Viking (a.k.a. La La)Land:

    Welcome, alongside Ohio, Pennsylvania, Florida, etc., to vote fruad reality! Come on, folks, why not lead the nation in paper ballots with a paper trail (including verification copy to the voter), and state legislation that makes mandatory sentencing the law of the state for any and all who are convicted of vote count maniplation, disenfranchisement, intimidation, fraud, etc.? I did what I had to do in 2006 when the El Paso County Clerk and Recorder booted me out of the election department when I wore my "Grandmother's for Peace" button (Google "Rita Ague). Two years later, the same clerk and recorder had to rescind his decision to disenfranchise hundreds of Colorado College students when the public outcry began veering in the direction of criminal and/or civil litigation. And guess what electronic vote counting system was pioneered here in El Paso County before it was taken statewide? If you guessed the "D" brand (applies to both damned and Diebold), you'd be right. Let's take back democracy and UNDO THE COUP!

Now we have one side wanting to count their votes but not the others, what is wrong with counting all the votes, I thought that was always the party line for the Democrats.     Isn't it possible to get this decided? It is not fair to me (a Californian) that there are only 99 Senators. It seems less fair to Minnesotans. I think I would feel the same way if Coleman were ahead by 312 votes. If 312 votes are not enough to decide an election, the legislature should pass a law providing for a re-vote in (say) a month if the margin is less than some amount.
    In the absence of such a law, how about a law that this sort of case should be expedited.

    THough Im not for Minnesota I have alwasy held that state in high regard as an example of living the american way. For the most part the people are honest, hard working, friendly, and smart.
    They must really smart under the never ending sore loser leagal fight of Coleman. Just another attempt by the Repubs to undo the will of the people.

    Although democracy is not perfect, this one is way off from the ballance. When is this going to end?
    If the court is not solving the issue leave both of them in one comfortable room and let them come to a compromise with a watchful eye of a guard. Next time it may be difficult to export our version of democracy to the third world where vote rigging or disfranchisement is more of a rule than exception. There are important bills on the floor of the Congress and the Al-Colman issue must have a resolution soon for the sake of the people's business.

    I have never seen this many people raise questions and even more concerns about how a "former" Senator (i.e. N.Coleman) of MN can [literally] be wasting our time and lives just to keep his egocentric BS in order [in his mind]. We have NO time for this you piece of crap!! I, as a Democrat during the '70s and '80s supported whomever was most truly concerned about how this country would look and BE. Now, it is just a matter of bull-crap decision makers forcing US[ALL!!!!] to have our lives wasted by this sort of Repub. In other words, YES, the southern voter that had supported Reagan is actually VERY mad to see the party of trikle down politics is working to spread the trikle-down to the level of a 1st grader looking decision-making mind. We have NO time or life room to watch this. The southern people are poorer, thanks to the BUSHes BS!! And we do not appreciate Norm and Company using their energies to keep NOTHING going onto US[ALL]. This party is, and has been, a money grubbing party of sell-outs. Only they are selling the US[all} out. My dad is a doctor of US Constitutional Law; and his friends and students are turning out to be VERY mad at this "policy of do-nothing NO-action". If we begin to see more violence in the nearer future(i.e. of whatever kind), it IS because of poop-eating, weak, scandalous selling out of others---just because you all have run out of "friends" (i.e. older folk that trusted you and younger folk that are/WERE looking to you for leadership but are NOT seeing any!!). Al Franken IS smart! I sent him money because of that fact. But the repubs are not concerned that they are screwing even their own people. Ahh! Yes! THIS IS why southerners are seeing thru your crap, now more than ever. The word pathetic is being used in the same sentences with republican-patheticism more than I have ever heard before. Norm!!     Okay, I don't live in Minnesota, but here goes. I think at least part of the objective has been, not so much to overturn Franken's victory, but rather to prevent him from being seated for as long as possible.
    The republican leadership got accustomed to having their way for so long that the setbacks they incurred in the last two elections has discombooberated their spinview.
    Time was, they could get by just doing things like substituting the word "stability" when they really meant "status quo". This bit of artful wordplay alone allowed them to do a lot of very destabilizing things while maintaining the status quo.
    Currently, as one example, there is a tendency for the status quo to tell people that alternative energy isn't so workable right now, because only fossil fuel and nuclear power plants can provide "stable, consistent power at all times, especially peak production periods. While that statement in itself may be a bit oversimplistic, even if it were true in all cases, the proper solution would be to build more alternative energy infrastructure, and then TURN OFF the fossil fuel plants until they were required. Either this has not occurred to them, or they hope it does not occur to other people.
    Other bits of wordplay - talking about the "cost" of healthcare reform, rather than talking about the cost of not reforming healthcare, (taking one set of dollar figures off a page and hammering people over the head with them, and pretending the other set of figures doesn't exist). I guess thats playing with numbers, not words.

    Now that Franken has finally won...let's just hope he's supports Obama's health care policy..who are these Democrats who won't support it. After all is said and done if a senator, republican or democrat does not see the need to support this change he or she must be in the pockets of health insurance companies. I cannot think of another explanation. I especially expect Holt, Lautenberg, and Menendez to be behind this policy.
