DSCC, DCCC, Fetterman Campaign File Lawsuit Opposing GOP’s Effort To Invalidate Mail Ballots

Voters should check their ballot status here

Today the Democratic Senatorial Campaign Committee (DSCC), Democratic Congressional Campaign Committee (DCCC), the Fetterman for PA campaign and affected voters have filed a lawsuit in the United States District Court for the Western District of Pennsylvania, Erie Division seeking to overturn the Pennsylvania Supreme Court’s ruling invalidating mail ballots that are incorrectly dated.

The lawsuit details that:

  • The federal Civil Rights Act prohibits election officials from denying any voter the right to vote because they made an error or omission that is not material in determining whether they are qualified to vote in that election.
  • Pennsylvania’s requirement that voters date the declarations accompanying their mail-in ballots has no relevance to determining whether an individual is qualified to vote, in violation of the Civil Rights Act, and serves no purpose other than to erect barriers to qualified voters exercising their fundamental constitutional right.

Voters should check their ballot status here and either take their correctly completed mail ballot to a drop off location, or vote in person on election day.

Joint statement from Christie Roberts, DSCC Executive Director, Tim Persico, DCCC Executive Director, and Brendan McPhillips, Fetterman for PA Campaign Manager: “As we fight this latest Republican attack on Americans’ democratic rights, Pennsylvanians should check their ballot status to ensure their vote is counted. We are committed to using every tool at our disposal to protect Pennsylvanians’ constitutional right to participate in this election, including defeating the GOP in court.”
