UPDATE: Minnesotans, DSCC & DCCC Win Lawsuit to End Unfair Ballot Order Statute

Minnesota voters, the DSCC, and the DCCC won a lawsuit today challenging Minnesota’s unconstitutional ballot order statute, which would have placed Democrats last on the ballot, because it creates arbitrary and unconstitutional disadvantages due to a well-documented “position bias.” As a result of today’s ruling, the Secretary of State will be required to adopt a procedure under which Minnesota’s four current major political parties are assigned, by lot, a single statewide ballot order that governs the appearance of the parties’ candidates.

“Political parties should compete on a level playing field, and no candidate should be forced to overcome systemic obstacles and unfair disadvantages simply because of their party’s success in the last election,” said DSCC Chair Catherine Cortez Masto. “This is an important win that will ensure impartial ballot order rules for Minnesota voters and underscores how important it is that we continue to stand up and fight for fair elections.”

“Minnesotans can now vote with the assurance that there won’t be any unconstitutional tricks on the ballot, giving one candidate an advantage just because of their political party,” said DCCC Chairwoman Cheri Bustos. “Today’s ruling protects the constitutional rights of every Minnesotan and is a victory for the integrity of our democracy.”
